Storage Auction Bidding Agreement
This Storage Auction Bidding Agreement ("Agreement") is made and entered into as of date indicated on the date of the registration form by and between:
Upstate Storage LLC ("Facility"), located at 2920 St Rt 3 Fulton NY 13069 and
Bidder Name indicated on the Bidder Registration Form ("Bidder").
Recitals:
WHEREAS, the Facility conducts auctions for the sale of abandoned or delinquent storage units pursuant to New York State law; and
WHEREAS, Bidder desires to participate in such auctions conducted by the Facility.
Agreement:
- Auction Participation:
- Bidder agrees to participate in storage unit auctions conducted by the Facility.
- Bidder acknowledges and understands that auctions are governed by New York State law and the rules and regulations of the Facility.
- Registration:
- Bidder shall register with the Facility prior to participating in any auction.
- Registration requires providing accurate identification and contact information.
- Bidding Process:
- Bidder acknowledges that all bids placed are binding and cannot be retracted once submitted.
- The highest bid accepted by the Facility shall be deemed the winning bid for the storage unit.
- Payment:
- Bidder agrees to pay for any storage units won at auction promptly.
- Payment shall be made at the conclusion of the auction.
- Accepted forms of payment include cash.
- If the highest bidder is unable to pay their bid the next highest bid will be awarded the contents of the unit.
- Removal of Contents:
- The bidder must remove all contents of the storage unit within 3 hours of winning the auction, unless otherwise specified by the Facility.
- The bidder assumes all responsibility for the removal and transportation of contents.
- Bidder may rent the unit if more time is needed to remove the contents, see facility manager to register as a renter.
- Any contents left after the agreed upon removal time will be considered Upstate Storage, LLC property and the bidder will be charged for the removal of items left. Fees associated with contents left behind will be charged to the Bidder, individuals not paid in full will be locked from bidding on future auctions until paid in full.
- The bidder acknowledges the following exclusions:
1. Any legal documents (i.e., birth certificates and passports) must be returned to the storage facility. The storage facility will try to return these to the owner.
2. Vehicles found within units require further research to determine lien and title status and may cause a halt in the auction proceedings.
3. Firearms must be turned over to the police.
- Non-Liability:
- The Facility makes no warranties or representations regarding the contents of storage units sold at auction.
- Bidder acknowledges that all units are sold "as is" and without any warranties.
- Indemnification:
- Bidder agrees to indemnify and hold harmless the Facility from any claims, liabilities, damages, or expenses arising out of or in connection with Bidder's participation in storage unit auctions.
- Governing Law:
- This Agreement shall be governed by and construed in accordance with the laws of the State of New York.
- Entire Agreement:
- This Agreement constitutes the entire understanding between the parties with respect to its subject matter and supersedes all prior agreements and understandings, whether written or oral.
IN WITNESS WHEREOF, the parties hereto have executed this Storage Auction Bidding Agreement as of the date first above written. The bidder acknowledges and agrees to all items listed in the Auction Bidding Agreement.
